B. DEFINITIONS To facilitate the understanding of these terms and conditions of LATAM NETWORKS LLC, it is necessary to clarify the meaning of the following words: a) WEB PAGE. These are the tourist activities that LATAM NETWORKS LLC currently provides or plans to provide in the future to users through the Viator / TripAdvisor website. c) USER OR VISITOR. A natural or legal person or entity of any nature who enters the Viator / TripAdvisor website to access, register, or sign up to receive a good or service from LATAM NETWORKS LLC for any reason, seek or consult information of interest. d) Viator / TripAdvisor. It is the operator and responsible for the platform or as well as the agent or intermediary between LATAM NETWORKS LLC and the client or visitor. e) PROVIDER. LATAM NETWORKS LLC will be responsible for providing activities or tourist tours on the Viator / TripAdvisor platform so that they can be acquired by customers or visitors. Likewise, it determines the policies for refunds, cancellations, changes, and responsibilities when carrying out the supplied activity. LATAM NETWORKS LLC operates as an intermediary of tourist services. LATAM NETWORKS LLC contracts other providers, who are the final provider of the referenced tourist activity / product. C. LIMITATION OF LIABILITY OF LATAM NETWORKS LLC Users acknowledge and accept that LATAM NETWORKS LLC acts solely as a provider of tourist services and, as such, does not assume any responsibility for any type of damage, harm, injury, loss, or expense, whether direct or indirect, arising in connection with the contracted tourist activities. Users acknowledge that LATAM NETWORKS LLC does not own, operate, or have any ownership over any vessels, modes of transport, or other assets used in the provision of the services offered through LATAM NETWORKS LLC and the OTAs like Viator / TripAdvisor. This includes, but is not limited to, large or small speedboats, horses, cars, vans, or any other vehicles, equipment, or property utilized for tours and excursions. These assets are provided by independent third-party suppliers, and LATAM NETWORKS LLC does not exercise control or oversight over the operation or maintenance of such assets. Users assume full and exclusive responsibility for their participation in the tourist activities, including, but not limited to, the inherent risks associated with such activities. It is the responsibility of users to acquire adequate travel insurance coverage, ensure compliance with the legal, ethical, and moral requirements set forth by LATAM NETWORKS LLC and its contractors, and to provide the necessary resources to handle any medical emergencies or unforeseen situations that may arise during the execution of the activities. To further clarify, LATAM NETWORKS LLC will not be responsible for damages, injuries, accidents, or incidents that occur inside or outside any vessels contracted by LATAM NETWORKS LLC or during the excursion, including but not limited to horseback riding, swimming, snorkeling, diving, use of jet skis, or any other water activities. LATAM NETWORKS LLC will also not assume responsibility for any reckless behavior of clients, such as excessive consumption of alcohol, psychoactive substances, or failing to adhere to safety instructions and recommendations. Users acknowledge that although LATAM NETWORKS LLC may hold commercial relationships with local contractors in the regions where it operates, any liability stemming from misconduct or negligence of these suppliers does not implicate LATAM NETWORKS LLC. LATAM NETWORKS LLC is not liable for any incidents arising from the actions of other third-party vendors or third-party activities. This includes, but is not limited to, interactions with local businesses, island vendors, beach vendors, transportation services, or any other third-party service providers or third-party activities. In the event that any client engages with third-party suppliers or deviates from the instructions and recommendations provided during any service or excursion sold by LATAM NETWORKS LLC, clients do so entirely at their own risk. LATAM NETWORKS LLC disclaims any liability arising from such interactions, and clients accept full responsibility for any consequences that may result from such engagements or deviations. The client agrees that their interactions with any such parties, before, during, and after the tour, are undertaken entirely at their own risk. LATAM NETWORKS LLC will not be responsible for any additional costs, losses, damages, or harm resulting from the modification or cancellation of services, delays, changes in itineraries, adverse weather conditions, criminal acts, force majeure, or any other event beyond its control. Users expressly release LATAM NETWORKS LLC, its directors, employees, agents, and representatives from any liability arising in connection with their participation in the contracted tourist activities, and users waive any claim, demand, or legal action against LATAM NETWORKS LLC and its affiliates. This waiver applies regardless of whether negligence on the part of LATAM NETWORKS LLC or its employees, agents, or representatives is proven. By contracting the tourist services offered by LATAM NETWORKS LLC, users acknowledge that they have read, understood, and agreed to these terms and conditions in their entirety. Users further acknowledge that they fully accept the risks involved in participating in these activities and agree to assume any and all responsibility arising from their involvement in the services provided. The tourist experiences or services offered by LATAM NETWORKS LLC are subject to possible modifications or suspensions in their realization, in order to offer better service to the client and adapt to unplanned eventualities or force majeure reasons that arise in the initially established programming to carry out the tourist service. Therefore, in the event of force majeure or fortuitous event occurring before or during the trip (such as strikes, accidents, civil unrest, natural disasters, adverse weather conditions, among others), LATAM NETWORKS LLC reserves the unilateral right to modify, replace or cancel itineraries, dates, hours, tours, and other tourist services, to ensure passenger safety. Refunds that may arise from unprovided services due to force majeure will be defined in the subsequent section entitled “refund policy.” LATAM NETWORKS LLC does not assume any responsibility for damages, harms, overcosts, or any other expense that the rescheduling of tourist services may cause to the user or visitor. D. DISCLAIMER FOR INACCURACY, EXHAUSTIVENESS, AND LACK OF UPDATING OF THE INFORMATION LATAM NETWORKS LLC reserves the right to cancel the tourist service without the right to a refund if it is verified that the user does not meet the necessary requirements for the development of the activity, or if they have not attached complete, exhaustive, and updated information at the time of purchase. This cancellation may occur before the start of the tourist service. The necessary requirements will be clearly stated in the description of the tourist service offered by Viator / TripAdvisor, and it is the exclusive responsibility of the user to ensure they meet them and provide the required information in full and accurately. In this sense, LATAM NETWORKS LLC may exclude a user from the tourist activity, (i) if they do not meet the participation requirements required on the Viator / TripAdvisor platform, (ii) if they would endanger themselves or others by participating or continuing to participate in the tourist activity, or (iii) if they would disrupt the implementation and safety standards of the activity with their participation. In these cases, the price paid for the reservation of the canceled activity will not be refunded. In these cases, LATAM NETWORKS LLC is exempt from any responsibility for the payment of damages, harms, expenses, or overcosts incurred by the user due to the non-provision of the tourist service due to incomplete or outdated information presented. Likewise, LATAM NETWORKS LLC will not be responsible for refunding the money initially paid to carry out the activity. E. REFUND POLICY LATAM NETWORKS LLC will make a full refund of the reservation price only for those cases where the tourist activity has been canceled more than 24 hours before the start of the activity. LATAM NETWORKS LLC will refrain from making a refund when the cancellation requested by the user has been made less than 24 hours before the start of the activity or in case of no-show. Considering that LATAM NETWORKS LLC may cancel the activity on the agreed date without the need to meet an early cancellation period, in cases where weather conditions, official measures, or other force majeure circumstances make the realization of the activity impossible, more difficult, or dangerous, LATAM NETWORKS LLC may reschedule the tourist activity without being responsible for the overcosts generated to the user or, failing that, will refund the client 50% of the amount initially paid for the execution of the tourist service. This policy is subject to changes and modifications as deemed necessary by LATAM NETWORKS LLC. Any updates will be communicated promptly to users. F. CANCELLATION AND CHANGE POLICY The client may only cancel the service agreements in accordance with the cancellation conditions established in these terms and conditions, as well as in the specific description of the activity on the LATAM NETWORKS LLC platform or any document issued for the activity. In order to avoid misunderstandings, all change requests (such as postponing the date of the activity or modifications in the participants) and cancellation requests must be made through the LATAM NETWORKS LLC platform. Change or cancellation requests must be made adequately 24 hours before the tourist activity is carried out. The feasibility of this request will be analyzed by LATAM NETWORKS LLC, considering aspects such as; the advance period within which the request was made and the availability of the activity for the new requested date. For a timely cancellation, it is essential that the notification is received on time by LATAM NETWORKS LLC. If these requirements are met, a cancellation/change confirmation will be issued on behalf of LATAM NETWORKS LLC. This confirmation will also serve as proof of the cancellation/change and, therefore, the user must keep it. LATAM NETWORKS LLC reserves the right to notify any change or cancellation, especially if it is on short notice, using the contact details provided by the client, such as the phone number or email address of the user. Based on the previously mentioned refund policy and these terms and conditions, the following cancellation conditions will apply: a) For cancellations more than 24 hours in advance of the start of the activity: a full refund of the reservation price will be made. b) For cancellations less than 24 hours in advance of the start of the activity or in case of no-show: no refund will be given. These policies are subject to changes and modifications as deemed necessary by LATAM NETWORKS LLC. Any updates will be communicated promptly to users. G. MINOR CHANGES IN THE TOURIST ACTIVITY LATAM NETWORKS LLC within 24 hours prior to the start of the reserved tourist activity, if deemed necessary, may make minor changes to the tourist program, due to unexpected circumstances that arise before the initially scheduled date. These modifications must be duly communicated through the user’s email. Minor changes in tourist programs refer to changes in the starting/meeting point of the activity, provided that the new meeting point can be reached on foot or by public transport in less than 15 minutes from the original meeting point. H. PRICES In most cases, the quoted prices include all taxes and fees. However, local taxes or additional fees may be charged at the location in question. If additional local taxes or fees apply, this will be indicated in the activity description and it will be the final customer’s responsibility to cover them. Prices set by providers may be subject to special conditions, for example, in relation to cancellations and refunds. Before booking, check this situation in the description of the tourist product. I. PERSONAL DATA PROCESSING The security of personal data is a priority for LATAM NETWORKS LLC, consequently, we inform you that, together with Viator / TripAdvisor, we have implemented and complied with the security levels required by current regulations regarding the collection, handling, and protection of data.
